Terms and Conditions for Online Payments - Kabrai Nagar Panchayat

The Terms and Conditions contained herein shall apply to any person (“User”) using the services of **Kabrai Nagar Panchayat** (KNP), for making Property tax payments through an online payment gateway service (“Service”) offered jointly by Indian Bank and Payment Gateway Service provider, through Kabrai Nagar Panchayat website i.e. https://kabrainp.in. Each User is therefore deemed to have read and accepted the Terms and Conditions.

A. Privacy Policy

  • a) In order to comply with any valid legal process such as search warrant, statute, or court order
  • b) if any of User’s actions on Kabrai Nagar Panchayat’s website violate the Terms of Service or any of KNP’s guidelines for specific services, or
  • c) to protect or defend KNP’s legal rights or property, the KNP site, or KNP Users; or
  • d) to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the security, integrity of the KNP website/offerings.

B. General Terms and Conditions for Online Payments

1. Once a User has accepted these Terms and Conditions, he/she may register and avail the Services. A User may either register on Kabrai Nagar Panchayat’s website or alternatively enter his/her Property ID number and pay their latest property tax dues/bills in any other manner as specified by KNP from time to time.

2. KNP's rights, obligations, undertakings shall be subject to the laws in force in India, as well as any directives/procedures of Government of India, and nothing contained in these Terms and Conditions shall be in derogation of KNP's right to comply with any law enforcement agencies request or requirements related to any User’s use of the website or information provided to or gathered by KNP with respect to such use.

3. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations, the remainder of the provision shall remain valid and enforceable.

4. These Terms and Conditions constitute the entire agreement between the User and KNP. These Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the User and KNP.

5. The entries in the books of KNP and/or the Payment Service Providers kept in the ordinary course of business shall be binding on the User and shall be conclusive proof of the genuineness and accuracy of the transaction.

6. Refund for Chargeback Transaction: In the event there is any claim for chargeback by the User for any reason, the User must approach KNP with their claim details and claim a refund from KNP directly.

7. In case of fraudulent/duplicate transactions, the User should directly contact KNP for any refund or disputes arising due to misuse of card or bank details.

C. Limitation of Liability

1. KNP has made this Service available to the User as a matter of convenience. KNP expressly disclaims any claim or liability arising out of the provision of this Service.

2. KNP and/or the Payment Service Providers shall not be liable for any inaccuracy, error, delay in, or omission of any data, information, or message or any loss or damage arising from or occasioned by any such inaccuracy or delay.

3. KNP and the Payment Service Providers assume no liability whatsoever for any monetary or other damage suffered by the User on account of server slow down, session timeout, or failure of any transaction.

4. The User shall indemnify and hold harmless the Payment Service Providers and KNP from any claims arising from their use of the Service.

D. Miscellaneous Conditions:

1. Any waiver of rights available to KNP under these Terms and Conditions shall not mean that those rights are automatically waived.

2. The User agrees that their personal data, including payment card details, may be susceptible to misuse or fraud and that KNP or the Payment Service Providers have no control over such matters.

3. KNP does not guarantee the prevention of unauthorized use of any information transmitted by the User over the Internet.

4. KNP and the Payment Service Providers shall not be liable for any failure of performance, error, omission, or theft of data.

5. The User agrees to keep their User ID and Password secure and confidential. KNP will never ask for the User’s password through unsolicited means.

E. Debit/Credit Card, Bank Account Details

1. The User agrees that the debit/credit card details provided for the Service(s) must be correct and accurate.

2. The User warrants that they are fully entitled to use the provided debit/credit card or bank account and that the details are valid and accurate.

3. The User authorizes the debit of the nominated card/bank account for the payment of property tax dues and related fees.

4. The User is responsible for ensuring sufficient funds are available in the nominated account to complete the transaction.

F. Personal Information

1. The User agrees that KNP and/or the Payment Service Providers may collect, use, and disclose personal information in connection with security or legal investigations.

2. The User agrees to be contacted via email by KNP for communication related to their transactions.

3. The User consents to the processing of their personal data in accordance with the privacy policy of KNP.

G. Payment Gateway Disclaimer

The Service is provided to facilitate online payment for property tax dues. KNP and the Payment Service Providers do not make any representation other than what is specified on the website for this purpose.
